Milford, UT (June 24, 2021) – The two victims who were killed in a car crash in Milford on Monday, June 21st have been identified. The driver was 47-year-old Misty Henrie. Her passenger was 41-year-old Stephen Polanshek.
Police said the accident took place at about 9:30 p.m. on Main Street in the area of 400 South when a Pontiac Grand Prix and a Honda motorcycle were seen traveling northbound on Main Street when, for reasons that have yet to be determined, both vehicles lost control. The Pontiac spun out, left the roadway, and crashed into a light pole and a building before coming to a stop in the oncoming lane of traffic.
The motorcycle crashed just south of the car and came to a stop in the northbound lane.
The occupants of the Pontiac, Henrie and Polanshek, were pronounced dead at the scene.
The motorcycle rider sustained non-critical injuries and was taken to a local hospital for treatment.
We would like to offer our deepest condolences to the families of the deceased victims, Mrs. Misty Henrie, and Mr. Polanshek, at this time. Our thoughts are with the injured victim and their family in hopes of a full recovery.
When the injured plaintiff or the respondent dies as the result of an automobile accident in Utah, judicial code 78B-3-107 lays the groundwork for any subsequent legal claim.
This law states that even though the injured party died, their estate still has a legal claim against the respondent. The death of the victim does not signify that the negligent driver is somehow excused from their financial obligation to the family or estate of the deceased.
This same law comes into play if the negligent driver died during the accident. In this situation, the claim for damages would instead be brought against the estate of the deceased.
This law is applied in cases where either the injured victim, at-fault driver, or both, are killed as a result of the crash. The victim’s claim for financial compensation is valid regardless of which side of the bench the deceased was on.
When victims pass away from injuries sustained in accidents caused by reckless, negligent, or careless drivers, their families may be entitled to compensation.
