When a driver fails to yield, it could cause several kinds of serious accidents, including head-on and side-impact collisions. Failure to yield at a crosswalk can also lead to dangerous collisions involving pedestrians and bicyclists. These demographics are extremely vulnerable due to their lack of any form of exterior protection.

Failure to yield the right of way is one of the primary causes of vehicle collisions across the country. A report published by a private firm that analyzes crash data supplied by insurance providers reveals that failing to yield is the fourth most common cause of fatal accidents, after failing to maintain their lane, driving while intoxicated, and speeding.

There are many reasons why one motorist may violate another’s right of way. The ones that occur most frequently in Utah are:

  • Drowsy Driving:When a driver is overly tired or seriously fatigued, they most likely lack the ability to give their surroundings their undivided attention. They are also less able to accurately judge distances and may not notice that another driver has the right of way.
  • Driving Under the Influence:Alcohol impairs your judgment and decreases your reaction time. A driver under the influence of drugs or alcohol can easily fail to yield to other vehicles or pedestrians. There are also some prescription drugs that can impede a driver’s ability to safely operate their vehicle.
  • Distracted Driving: Anytime a driver is distracted by something inside or outside of their car, they are not paying attention to the roadway. This puts them in danger of disregarding the right of way of another driver. The National Highway Traffic Safety Administration said that distracted driving is any activity that shifts someone’s focus away from driving, such as talking on your phone, texting, eating or drinking, using the stereo, or talking to passengers.
