Liability for Job Site Accidents in Utah

When someone is injured or killed in an accident through no fault of their own, they are typically able to seek financial recovery from the negligent party to mitigate the financial burdens they now face for medical treatment, lost income, property repairs, and many other economic and non-economic damages.

The primary advantage of a personal injury suit is that it enables victims or their surviving family members to collect compensation for pain and suffering, a benefit that is unavailable in a worker’s compensation claim.

With a personal injury claim, victims can pursue damages for things such as lost wages, decreased earning capacity, medical bills, future medical bills, lifelong handicaps, pain and suffering, and diminished quality of life.

The benefits available through worker’s compensation, which, at its essence, is nothing more than an agreement between business owners and their labor force, are extremely limited.
