We would like to offer our deepest condolences to the family of the deceased victim at this time. Our thoughts are with the injured victim and their family in hopes of a full recovery.

The primary form of damages sought in a wrongful death suit are those endured by the deceased from the time of their accident until the time of their death.

These damages could include any hospital expenses for emergency treatment and care the deceased received, any pain or suffering they experienced due to their injury, and funeral and cremation or burial expenses. A knowledgeable wrongful death lawyer can examine the details of your case and advise you on which damages apply to your case.

The second form of damages victims are entitled to seek are those endured by the family resulting from the deceased’s passing. These include monetary losses, such as the loss of wages and job-related benefits the deceased would have contributed if they were still alive, along with the emotional losses stemming from the death.

Emotional losses include things like mental anguish, loss of consortium, loss of care, and loss of guidance. An experienced wrongful death attorney can calculate a dollar figure for these non-economic damages.

The family member filing the lawsuit might also be able to pursue punitive damages. These are intended to punish an offender when their negligent actions were particularly reckless or egregious. Punitive damages are also used to discourage others from acting the same way. Not all cases merit punitive damages. A knowledgeable wrongful death attorney can correctly gauge if they apply to your case.
