Hurricane, UT (November 03, 2021) – A man was charged with DUI on Saturday, October 30th when the utility task vehicle he was driving rolled off an embankment near Old Highway 91 in Hurricane, leaving one passenger seriously injured.
At about 10:30 p.m., officers responded to reports of a rollover accident with injuires on Old Highway 91 involving a UTV carrying four occupants.
According to a probable cause statement, officers found the front seat passenger sustained a huge laceration to his head and what was later determined to be a broken neck. He was transported by ambulance to St. George Regional Medical Center for emergency medical treatment.
The two juveniles riding in the backseat both sustained non-critical injuries.
A breathalyzer test administered at the scene showed the driver had a blood alcohol content of .191%, almost four times Utah’s legal limit. He is facing charges of third-degree felony DUI with serious bodily injury, as well as reckless driving, and two counts of DUI with a child in the vehicle, each of which is a misdemeanor.
Our thoughts are with the injured victim and their family at this time. We hope for their full recovery.
In 2018 and 2019, the rate of arrests for drunk drivers fell by 4%. Most of these drivers were arrested in Davis, Utah, Weber, and Salt Lake counties, making up 70% of Utah’s DUI arrests. Every remaining county outside of Wasatch Front combined made up only 30% of the state’s DUI accidents, a total that is disproportionate to the region’s population.
No different than other types of car crashes, liability on the part of the intoxicated driver has to be established in order for you to recover compensation for your losses. Losses in a DUI claim include both economic and non-economic. In a very small number of cases, punitive damages can also be pursued due to the driver exhibiting gross negligence in their decision to drive drunk.
When injuries are sustained during a crash due to another party’s negligence, victims should immediately seek legal guidance from an accident attorney in Hurricane. Anytime somebody is harmed and another person was the cause of that harm, they are able to receive financial compensation for their damages and losses.
