When you are injured during a car accident in Utah, you have two options available when it comes to securing compensatory damages. You can either file a claim with the insurance carrier or you can file a personal injury claim in civil court. Utah follows no-fault insurance laws, which means that drivers a required to carry certain amounts of personal injury protection.
Prior to filing a claim with the at-fault driver’s insurance company or filing a claim, you first have to file a claim with your own insurance company. There are some factors that could excuse you from these rules, like sustaining permanent disabilities or impairment, permanent disfigurement, dismemberment, and medical expenses in excess of $3,000.
